ARGUMENT TO NEW JERSEY SUPREME COURT
Michael Gordon of Gordon & Gordon presented arguments to the New
Jersey Supreme Court on Tuesday, November 28, 2006 fighting to uphold
the decision to bring public nuisance claims against the lead pigment
industry. Defendants in the case include Sherwin Williams, Atlantic
Richfield, NL Industries, Millennium Inorganic Chemicals, American
Cyanamid, Cytec Industries, DuPont, and ConAgra. These companies
manufactured, promoted and sold lead pigment over several decades with
the knowledge that their lead pigment could seriously harm children.
It was ruled in August 2005 by the New Jersey Appellate Court that
cities and counties across the state of New Jersey be allowed to bring a
public nuisance claim against the lead pigment industry. The court ruled
that the public nuisance lawsuit by New Jersey government entities would
“foster the goal” of New Jersey’s Lead Paint Statute. Defendants filed
an appeal to that decision.
“It is imperative that this industry be held for their actions and I
am proud to be leading the fight against the manufacturers of lead-based
pigment”, said Michael Gordon. “Lead paint poisoning remains one of the
most serious, yet preventable, threats to our children and a court
victory in New Jersey will help secure funding for the critically needed
abatement. It is time for these companies that helped create the lead
poisoning problem to become part of the solution by working to rid our
homes and buildings of dangerous paint containing lead pigment.”
